These terms govern the services and digital products sold by Honest Mistake OÜ ("we", "us"), a private limited company registered in Estonia, registry code 16281128, VAT number EE102396120, address P. Kerese tn 48, 11215 Tallinn, Estonia. By ordering our services or using this website you agree to these terms.
We provide digital product design and development services (design sprints, app design and development, and hourly design direction) and we make digital products of our own. Our current products and services, with prices in euros (EUR), are listed on the products page. The Photolog iOS app is distributed through the Apple App Store and any in-app purchases are governed by Apple's terms.
Project work is agreed in a written proposal that states the scope, deliverables, timeline and fixed price. The proposal, once accepted in writing (email is fine), forms the contract together with these terms. Hourly work is agreed by email and billed on actual hours.
All prices are in euros (EUR) and exclude VAT, which is added where Estonian law requires it. Project work starts after the first invoice is paid; hourly work is invoiced monthly in arrears. Invoices are payable within 14 days by bank transfer to our Estonian business account. When we accept card payments, they are processed by a licensed payment processor; your card details never reach our servers, and all payment pages are served over HTTPS.
All deliverables are digital and are delivered electronically (repository access, file transfer, or App Store release). Delivery timelines are stated in the proposal. See our refunds and delivery policy for details.
Upon full payment, the agreed deliverables and their rights transfer to the client, except for our pre-existing tools, libraries and know-how, which we license to the client for use within the delivered work. We may show completed work in our portfolio unless agreed otherwise in the proposal.
Cancellation and refund rules, including the EU 14-day right of withdrawal for consumers, are described in the refunds and delivery policy, which is part of these terms.
We deliver careful, professional work, and we fix our mistakes at our own cost when you report them within 30 days of delivery. Beyond that, our total liability under a contract is limited to the fees paid under that contract. We are not liable for indirect damages or lost profits. Nothing in these terms limits liability that cannot be limited under Estonian law.
These terms are governed by Estonian law. Disputes are resolved by negotiation first; failing that, in Harju County Court, Estonia. Consumers in the EU may also use their local consumer protection channels or the EU online dispute resolution platform.
We may update these terms; the version published on this page at the time of your order applies to that order.
